Welcome to BeanStalk, a personal assessment and eLearning web application ("BeanStalk," "we," "us," or "our"). Before you use our services, please carefully read and understand the following Terms & Conditions ("Terms") that govern your access to and use of our application. By accessing or using BeanStalk, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use BeanStalk.
1. Acceptance of Terms
By accessing or using BeanStalk, you agree to these Terms and all applicable laws and regulations. If you are using BeanStalk on behalf of an organization, you represent that you have the authority to bind the organization to these Terms.
2. Intellectual Property
2.1 Ownership
All content available on BeanStalk, including but not limited to text, graphics, videos, assessments, and interactive modules, is the intellectual property of BeanStalk or its licensors. You are granted a limited, non-exclusive, and non-transferable license to access and use this content solely for your personal, non-commercial use as intended within the application.
2.2 Restrictions
You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, or otherwise use any content from BeanStalk in any form outside of the application without prior written consent from BeanStalk.
3. Registration and User Account
3.1 Account Creation
To access certain features of BeanStalk, you may need to create a user account. You agree to provide accurate and complete information during the registration process and to keep your account information updated.
3.2 Security
You are responsible for maintaining the security of your account credentials and are solely responsible for any activities that occur under your account. You must promptly notify us of any unauthorized access or use of your account.
4. Privacy
Your use of BeanStalk is also governed by our Privacy Policy, which can be found at https://bean-stalk.io/privacy-policy/ . By using BeanStalk, you consent to the collection, use, and disclosure of your information as described in the Privacy Policy.
5. User Conduct
When using BeanStalk, you agree to:
5.1 Comply with Applicable Laws
Use BeanStalk in compliance with all applicable laws and regulations.
5.2 Respect Others
Refrain from engaging in any activity that is harmful, abusive, harassing, or disruptive to other users or our services.
6. Payment and Lifetime Access
6.1 Free Trial Period
BeanStalk may offer users a free trial period during which they have access to one assessment for a specific duration (e.g., 2 weeks) at no cost. This free trial period is subject to change at our discretion and may vary based on promotions and offers.
6.2 One-Time Payment for Lifetime Access
To continue accessing the assessment after the free trial period expires, users may be required to make a one-time payment. Upon payment, users will be granted lifetime access to that specific assessment, subject to the terms of these Terms & Conditions.
6.3 Closure of BeanStalk
In the event that BeanStalk ceases to operate or is discontinued, the lifetime access to assessments obtained through payment may also come to an end. BeanStalk shall have no further obligation to provide access or refunds in such circumstances.
6.4 Payment Terms
Payment methods, pricing, and payment terms for assessments will be provided to you at the time of purchase. By making a payment, you agree to the applicable payment terms and authorize BeanStalk to charge your chosen payment method.
6.5 Refunds
Except as required by applicable law, all payments for assessments are non-refundable. Please note that the availability of free trials, pricing, and payment terms may vary and are subject to change at our discretion. Lifetime access is contingent upon the continued operation of BeanStalk as stated in these Terms & Conditions.
7. Termination
BeanStalk reserves the right to terminate or suspend your access to the application, without prior notice, for any reason, including if we believe you have violated these Terms or engaged in any unlawful activity. In the event of an account suspension initiated by BeanStalk, and if you have previously made a one-time payment for lifetime access to an assessment, we may, at our sole discretion, provide a prorated reimbursement of the subscription cost for the remaining unused access period. However, this reimbursement is subject to the circumstances surrounding the account suspension and any violations of these Terms. BeanStalk shall have the final decision regarding the eligibility for reimbursement and the amount to be reimbursed, if any.
8. Disclaimers
8.1 No Warranty
BeanStalk is provided "as-is" and "as available." We make no warranties, express or implied, regarding the accuracy, reliability, or availability of our services.
8.2 Limitation of Liability
BeanStalk shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.
9. Modifications
We reserve the right to update or modify these Terms at any time. Any changes will be effective upon posting on BeanStalk. Your continued use of BeanStalk after such changes constitutes your acceptance of the revised Terms.
